And if any person shall take or destroy, or attempt to take or destroy, any fish, in any other inclosed ground, being private property, without the consent of the owner, he shall upon conviction by one justice forfeit 5_l._ to the owner of the pond or fishery, and, in default of payment, shall be committed to the house of correction for any time not exceeding six months.
