سَأَلْتُ أَبَا الْحَسَنِ ( عليه السلام ) فَقُلْتُ إِنَّ بَعْضَ أَصْحَابِنَا رَوَى أَنَّ لِلرَّجُلِ أَنْ يَنْكِحَ جَارِيَةَ ابْنِهِ وَ جَارِيَةَ ابْنَتِهِ وَ لِيَ ابْنَةٌ وَ ابْنٌ وَ لِابْنَتِي جَارِيَةٌ اشْتَرَيْتُهَا لَهَا مِنْ صَدَاقِهَا أَ فَيَحِلُّ لِي أَنْ أَطَأَهَا فَقَالَ لَا إِلَّا بِإِذْنِهَا قَالَ الْحَسَنُ بْنُ الْجَهْمِ أَ لَيْسَ قَدْ جَاءَ أَنَّ هَذَا جَائِزٌ قَالَ نَعَمْ ذَاكَ إِذَا كَانَ هُوَ سَبَبَهُ ثُمَّ الْتَفَتَ إِلَيَّ وَ أَوْمَأَ نَحْوِي بِالسَّبَّابَةِ فَقَالَ إِذَا اشْتَرَيْتَ أَنْتَ لِابْنَتِكَ جَارِيَةً أَوْ لِابْنِكَ وَ كَانَ الِابْنُ صَغِيراً وَ لَمْ يَطَأْهَا حَلَّ لَكَ أَنْ تَفْتَضَّهَا فَتَنْكِحَهَا وَ إِلَّا فَلَا إِلَّا بِإِذْنِهِمَا .
Translation
A number of our companions, from Sahl Bin Ziyad, from Musa Bin Ja’far, from Amro Bin Saeed, from Al Hassan Bin Sadaqa who said, ‘I asked Abu Al-Hassan<sup>asws</sup>, so I said, ‘One of our companions reported that for the man is that he marries a slave girl of his son, and a slave girl of his daughter, and for me there is a daughter and a son, and for my daughter is a slave girl which I bought for her from her dower. So is it Permissible for me that I sleep with her?’ So he<sup>asws</sup> said: ‘No, except by her (daugher’s) permission’. Al-Hassan Bin Al-Jaham said, ‘Has it not come (in a Hadeeth) that this is allowed?’ He<sup>asws</sup> said: ‘Yes, that is when it was his reason’. Then he turned towards me<sup>asws</sup> and gestured towards me with the index finger. So he<sup>asws</sup> said: ‘When you buy a slave girl for your daughter or for your son, and the son was young and did not sleep with her, it is Permissible for you that you deflower her and marry her, or else so no, except with their permission’.
