الْعَبْدِ يَتَزَوَّجُ الْحُرَّةَ ثُمَّ يُعْتَقُ فَيُصِيبُ فَاحِشَةً قَالَ فَقَالَ لَا يُرْجَمُ حَتَّى يُوَاقِعَ الْحُرَّةَ بَعْدَ مَا يُعْتَقُ قُلْتُ فَلِلْحُرَّةِ عَلَيْهِ الْخِيَارُ إِذَا أُعْتِقَ قَالَ لَا قَدْ رَضِيَتْ بِهِ وَ هُوَ مَمْلُوكٌ فَهُوَ عَلَى نِكَاحِهِ الْأَوَّلِ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Ibn Raib, from Abu Baseer, (It has been narrated) from Abu Abdullah<sup>asws</sup> regarding the slave who marries the free woman, then he is emancipated, so he commits immorality. So he<sup>asws</sup> said: ‘He would not be stoned until he falls upon the free woman after having been emancipated’. I said, ‘So, for the free woman would be the choice upon him, when he is emancipated?’ He<sup>asws</sup> said: ‘No. She was pleased with him and he was a slave, so he would be upon his first marriage’.
