John Shaqi

سَأَلْتُهُ عَنِ الْمَرْأَةِ الْحُرَّةِ تَكُونُ تَحْتَ الْمَمْلُوكِ فَتَشْتَرِيهِ هَلْ يُبْطِلُ ذَلِكَ نِكَاحَهُ قَالَ نَعَمْ لِأَنَّهُ عَبْدٌ مَمْلُوكٌ لَا يَقْدِرُ عَلَى شَيْ‏ءٍ .


Translation

Muhammad Bin Ja’far Abu Al Abbas, from Ayoub Bin Nuh, from Safwan, from Saeed Bin Yasaar who said, ‘I asked him<sup>asws</sup> about the free woman who happens to be under the slave (as his wife), would that invalidate his marriage?’ He<sup>asws</sup> said: ‘Yes, because an owned slave has no power over anything’.
