قُلْتُ لِأَبِي عَبْدِ اللَّهِ ( عليه السلام ) رَجُلٌ أُخِذَ مَعَ امْرَأَةٍ فِي بَيْتٍ فَأَقَرَّ أَنَّهَا امْرَأَتُهُ وَ أَقَرَّتْ أَنَّهُ زَوْجُهَا فَقَالَ رُبَّ رَجُلٍ لَوْ أُتِيتُ بِهِ لَأَجَزْتُ لَهُ ذَلِكَ وَ رُبَّ رَجُلٍ لَوْ أُتِيتُ بِهِ لَضَرَبْتُهُ .
Translation
Abu Ali Ashary, form Muhammad Bin Abdul Jabbar, from Muhammad Bin Ismail, from Ali Bin Numan, from Suweyd Al Qalla’a, from Sama’at, from Abu Baseer who said, ‘I said to Abu Abdullah<sup>asws</sup>, ‘A man who is seized with a woman in a house. So he agrees that she is his wife, and she agrees that he is her husband’. So he<sup>asws</sup> said: ‘Sometimes a man, if they come with him, I<sup>asws</sup> would allow that for him (based on the circumastances), and sometimes, if they were to come with him, (based on the circumstances), I<sup>asws</sup> would whip him’.
