John Shaqi

إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ وَ هِيَ حُبْلَى أَنْفَقَ عَلَيْهَا حَتَّى تَضَعَ حَمْلَهَا وَ إِذَا وَضَعَتْهُ أَعْطَاهَا أَجْرَهَا وَ لَا يُضَارَّهَا إِلَّا أَنْ يَجِدَ مَنْ هُوَ أَرْخَصُ أَجْراً مِنْهَا فَإِنْ هِيَ رَضِيَتْ بِذَلِكَ الْأَجْرِ فَهِيَ أَحَقُّ بِابْنِهَا حَتَّى تَفْطِمَهُ .


Translation

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Muhammad Bin Ismail, form Muhammad Bin Al Fazeyl, from Abu Al Sabbah Al Kinany, (It has been narrated) from Abu Abdullah<sup>asws</sup> having said: ‘When the man divorces his wife, and she is pregnant, he has to spend upon her until she places her burden (give birth); and when she has placed it, he has to give her, her recompense (for breast feeding), and he should not harm her except if he finds one who is cheaper in recompense than her. So if she is pleased with that recompense, so she would be more rightful with her son, until she weans him’.
