أُمِّ وَلَدٍ لَيْسَ لَهَا وَلَدٌ مَاتَ وَلَدُهَا وَ مَاتَ عَنْهَا صَاحِبُهَا وَ لَمْ يُعْتِقْهَا هَلْ يَحِلُّ لِأَحَدٍ تَزْوِيجُهَا قَالَ لَا هِيَ أَمَةٌ لَا يَحِلُّ لِأَحَدٍ تَزْوِيجُهَا إِلَّا بِعِتْقٍ مِنَ الْوَرَثَةِ فَإِنْ كَانَ لَهَا وَلَدٌ وَ لَيْسَ عَلَى الْمَيِّتِ دَيْنٌ فَهِيَ لِلْوَلَدِ وَ إِذَا مَلَكَهَا الْوَلَدُ فَقَدْ عَتَقَتْ بِمِلْكِ وَلَدِهَا لَهَا وَ إِنْ كَانَتْ بَيْنَ شُرَكَاءَ فَقَدْ عَتَقَتْ مِنْ نَصِيبِ وَلَدِهَا وَ تُسْتَسْعَى فِي بَقِيَّةِ ثَمَنِهَا .
Translation
Ali Bin Ibrahim, from his father, from Ismail Bin Marrar, and someone else, from Yunus, (It has been narrated) regarding a mother of a child, not having a child, for her child had died, and her master died from her, and did not emancipate her. Is it permissible for anyone to marry her?’ He<sup>asws</sup> said: ‘No, she is a slave. It is not Permissible for anyone to marry her except by emancipating her from the inheritors. So if there was a child for her, and there is no debt upon the deceased, so she is for the child, and when her child owns her, so she is emancipated by the ownership of the child of hers, even though it may be between partners, so she has been emancipated from the share of her child, and she would work with regards to the remainder of her price’.
