قُلْتُ لَهُ جُعِلْتُ فِدَاكَ الطَّيْرُ يَقَعُ عَلَى الدَّارِ فَيُؤْخَذُ أَ حَلَالٌ هُوَ أَمْ حَرَامٌ لِمَنْ أَخَذَهُ فَقَالَ يَا إِسْمَاعِيلُ عَافٍ أَمْ غَيْرُ عَافٍ قَالَ قُلْتُ جُعِلْتُ فِدَاكَ وَ مَا الْعَافِي قَالَ الْمُسْتَوِي جَنَاحَاهُ الْمَالِكُ جَنَاحَيْهِ يَذْهَبُ حَيْثُ شَاءَ قَالَ هُوَ لِمَنْ أَخَذَهُ حَلَالٌ .
Translation
And from him, from Ibn Fazzal, from Ubeyd Bin Hafs Bin Qurat, from Ismail Bin Jabir, (It has been narrated) from Abu Abdullah<sup>asws</sup>, said, ‘I said to him<sup>asws</sup>, ‘May I be sacrificed for you<sup>asws</sup>! The bird falls upon the house, so it is seized. Is it Permissible or Prohibited, for the one who seizes it?’ So he<sup>asws</sup> said: ‘O Ismail! Is it complete or not complete (its wings)?’ I said, ‘May I be sacrificed for you<sup>asws</sup>! And what is complete?’ He<sup>asws</sup> said: ‘The one who wings are level, in control of its wings going with them wherever it so desires to’. He<sup>asws</sup> said: ‘It is for the one who seizes it’.
