رَجُلٍ ضَرَبَ بِسَيْفِهِ جَزُوراً أَوْ شَاةً فِي غَيْرِ مَذْبَحِهَا وَ قَدْ سَمَّى حِينَ ضَرَبَ فَقَالَ لَا يَصْلُحُ أَكْلُ ذَبِيحَةٍ لَا تُذْبَحُ مِنْ مَذْبَحِهَا يَعْنِي إِذَا تَعَمَّدَ لِذَلِكَ وَ لَمْ تَكُنْ حَالُهُ حَالَ اضْطِرَارٍ فَأَمَّا إِذَا اضْطُرَّ إِلَيْهَا وَ اسْتَصْعَبَتْ عَلَيْهِ مَا يُرِيدُ أَنْ يَذْبَحَ فَلَا بَأْسَ بِذَلِكَ .

علی بن ابراہیم نے اپنے والد سے، انہوں نے ابن ابی عمیر سے، انہوں نے حماد سے، انہوں نے حلبی سے، انہوں نے ابو عبد اللہ علیہ السلام سے روایت کی ایک آدمی کے بارے میں جس نے اپنی تلوار سے اونٹ یا بکری کو اس کی ذبح کی مقررہ جگہ کے علاوہ کسی جگہ مارا، اور ضرب لگاتے وقت بسم اللہ بھی پڑھی۔ آپ نے فرمایا: ایسے ذبیحے کو کھانا جائز نہیں جسے اس کی ذبح گاہ سے ذبح نہ کیا گیا ہو — یعنی جب یہ جان بوجھ کر کیا گیا ہو اور اس کی حالت مجبوری کی حالت نہ ہو۔ لیکن جب وہ مجبور ہو اور جسے ذبح کرنا چاہتا ہو وہ اس پر مشکل ہو جائے، تو اس میں کوئی حرج نہیں۔
Translation
Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullah<sup>asws</sup> regarding a man who struck with his sword, a camel or a sheep, in other than its slaughtering place, and he had Named (<span class="iTxt">Bismillah</span>) when he struck. So he<sup>asws</sup> said: ‘It is not correct to slaughter an (animal) which has not been slaughter from its (proper) slaughtering place, meaning when you are deliberate for that, and his state does not happen to be a state of desperation. So as for what he is desperate towards, and it is difficult upon him, what he intends to slaughter, so there is no problem with that’.
