فِي رَجُلٍ أَوْصَى بِأَكْثَرَ مِنَ الثُّلُثِ وَ أَعْتَقَ مَمْلُوكَهُ فِي مَرَضِهِ فَقَالَ إِنْ كَانَ أَكْثَرَ مِنَ الثُّلُثِ رُدَّ إِلَى الثُّلُثِ وَ جَازَ الْعِتْقُ .
Translation
Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from a man, from Muhammad Bin Muslim, (It has been narrated) from Abu Ja’far<sup>asws</sup> having said regarding a man who bequeathed more than the third, and emancipated (liberated) his slave during his illness. So he<sup>asws</sup> said: ‘If it was more than the third, return it to the third; and the emancipation is Permissible’.
