وَقَعَ بَيْنَ رَجُلَيْنِ مِنْ بَنِي عَمِّي مُنَازَعَةٌ فِي مِيرَاثٍ فَأَشَرْتُ عَلَيْهِمَا بِالْكِتَابِ إِلَيْهِ فِي ذَلِكَ لِيَصْدُرَا عَنْ رَأْيِهِ فَكَتَبَا إِلَيْهِ جَمِيعاً جَعَلَنَا اللَّهُ فِدَاكَ مَا تَقُولُ فِي امْرَأَةٍ تَرَكَتْ زَوْجَهَا وَ ابْنَتَهَا لِأَبِيهَا وَ أُمِّهَا وَ قُلْتُ جُعِلْتُ فِدَاكَ إِنْ رَأَيْتَ أَنْ تُجِيبَنَا بِمُرِّ الْحَقِّ فَخَرَجَ إِلَيْهِمَا كِتَابٌ بِسْمِ اللَّهِ الرَّحْمَنِ الرَّحِيمِ عَافَانَا اللَّهُ وَ إِيَّاكُمَا أَحْسَنَ عَافِيَةٍ فَهِمْتُ كِتَابَكُمَا ذَكَرْتُمَا أَنَّ امْرَأَةً مَاتَتْ وَ تَرَكَتْ زَوْجَهَا وَ ابْنَتَهَا وَ أُخْتَهَا لِأَبِيهَا وَ أُمِّهَا فَالْفَرِيضَةُ لِلزَّوْجِ الرُّبُعُ وَ مَا بَقِيَ فَلِلِابْنَةِ .
Translation
A number of our companions, from Ahmad Bin Muhammad Bin Isa, from Muhammad Bin Al Hassan Al Ashary who said, ‘There occurred a dispute among two men from the sons of my uncle regarding inheritance. So I advised them to write a letter to him<sup>asws</sup> with regards to that in order to acquire his<sup>asws</sup> view. So they both wrote to him together, ‘May Allah<sup>azwj</sup> Make us to be sacrificed for you<sup>asws</sup>! What are you<sup>asws</sup> saying regarding a woman who left her husband and her daughter of her father and her mother?’ And I said, ‘May I be sacrificed for you<sup>asws</sup>! If you<sup>asws</sup> give your<sup>asws</sup> view, answer us with the bitterness of the truth’. So there came out a letter to them both: ‘In the Name of Allah<sup>azwj</sup> the Beneficent, the Merciful. May Allah<sup>azwj</sup> Grant us<sup>asws</sup> and you good health, with the best of health. I understood your letter wherein you mentioned that a woman died and left her husband, and her daughter, and her sister from her father and her mother. So the Obligation (legislated shares of inheritance) is – for the husband is the one-quarter, and whatever remains is for the daughter’.
