سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلام ) عَنْ رَجُلٍ تَرَكَ أَخَاهُ لِأُمِّهِ لَمْ يَتْرُكْ وَارِثاً غَيْرَهُ قَالَ الْمَالُ لَهُ قُلْتُ فَإِنْ كَانَ مَعَ الْأَخِ لِلْأُمِّ جَدٌّ قَالَ يُعْطَى الْأَخُ لِلْأُمِّ السُّدُسَ وَ يُعْطَى الْجَدُّ الْبَاقِيَ قُلْتُ فَإِنْ كَانَ الْأَخُ لِأَبٍ وَ جَدٌّ قَالَ الْمَالُ بَيْنَهُمَا سَوَاءً .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Ibn Sinan who said, ‘I asked Abu Abdullah<sup>asws</sup> about a man who left his brother from his mother, not having left an inheritor apart from him’. He<sup>asws</sup> said: ‘The wealth is for him’. I said, ‘So if there was with the brother from the mother, a grandfather?’ He<sup>asws</sup> said: ‘The brother from the mother would be given a one-sixth, and the grandfather would be given the remainder’. I said, ‘So if there was a brother from the father, and a grandfather?’ He<sup>asws</sup> said: ‘The wealth would be (divided) between the two of them, equally’.
