كَتَبْتُ إِلَى أَبِي مُحَمَّدٍ ( عليه السلام ) امْرَأَةٌ مَاتَتْ وَ تَرَكَتْ زَوْجَهَا وَ أَبَوَيْهَا أَوْ جَدَّهَا أَوْ جَدَّتَهَا كَيْفَ يُقْسَمُ مِيرَاثُهَا فَوَقَّعَ ( عليه السلام ) لِلزَّوْجِ النِّصْفُ وَ مَا بَقِيَ فَلِلْأَبَوَيْنِ وَ قَدْ رُوِيَ أَيْضاً أَنَّ رَسُولَ اللَّهِ ( صلى الله عليه وآله ) أَطْعَمَ الْجَدَّ وَ الْجَدَّةَ السُّدُسَ .
Translation
And from him and Ali Bin Abdullah, both together from Ibrahim, from Abdullah Bin Ja’far who said, ‘I wrote to Abu Muhammad<sup>asws</sup>, ‘A woman died and left her husband, and her parent, or her grandfather, or her grandmother. How should her inheritance be distributed?’ So he<sup>asws</sup> signed: ‘For the husband is the half, and what remains, so it is for the two parents’. And it has also been reported as well that Rasool-Allah<sup>saww</sup> provided the one-sixth for the grandfather and the grandmother’.
