John Shaqi

سَأَلْتُهُ عَنْ مُكَاتَبٍ يُؤَدِّي بَعْضَ مُكَاتَبَتِهِ ثُمَّ يَمُوتُ وَ يَتْرُكُ ابْناً لَهُ مِنْ جَارِيَتِهِ قَالَ إِنْ كَانَ اشْتُرِطَ عَلَيْهِ صَارَ ابْنُهُ مَعَ أُمِّهِ مَمْلُوكَيْنِ وَ إِنْ لَمْ يَكُنِ اشْتُرِطَ عَلَيْهِ صَارَ ابْنُهُ حُرّاً وَ أَدَّى إِلَى الْمَوَالِي بَقِيَّةَ الْمُكَاتَبَةِ وَ وَرِثَ ابْنُهُ مَا بَقِيَ .


Translation

Humeyd Bin ziyad, from Al Hassan Bin Muhammad, from Muhammad Bin Ziyad, from Muhammad Bin Humran, (It has been narrated) from Abu Abdullah<sup>asws</sup>, said, ‘I asked him<sup>asws</sup> about a contracted slave who had paid off some of his contractual amount, then died, and left a son of his from his slave girl. He<sup>asws</sup> said: ‘If there was a stipulated condition upon him, his son and his slave girl would become two slaves, and if there was no stipulated condition upon him, his son would become free and pay off to the master the remainder of the contract, and his son would inherit whatever remains’.
