سَأَلْتُهُ عَنْ وَلَدِ الْمُلَاعَنَةِ إِذَا تَلَاعَنَا وَ تَفَرَّقَا وَ قَالَ زَوْجُهَا بَعْدَ ذَلِكَ الْوَلَدُ وَلَدِي وَ أَكْذَبَ نَفْسَهُ قَالَ أَمَّا الْمَرْأَةُ فَلَا تَرْجِعُ إِلَيْهِ وَ لَكِنْ أَرُدُّ إِلَيْهِ الْوَلَدَ وَ لَا أَدَعُ وَلَدَهُ لَيْسَ لَهُ مِيرَاثٌ فَإِنْ لَمْ يَدَّعِهِ أَبُوهُ فَإِنَّ أَخْوَالَهُ يَرِثُونَهُ وَ لَا يَرِثُهُمْ فَإِنْ دَعَاهُ أَحَدٌ بِابْنِ الزَّانِيَةِ جُلِدَ الْحَدَّ .
Translation
Abu Ali Al Ashary, from Al Hassan Bin Ali Al Kufy, from Ubays Bin Hisham, from Sabit, from Abu Baseer, (It has been narrated) from Abu Abdullah<sup>asws</sup>, said, ‘I asked him<sup>asws</sup> about a child of the mother cursed by her husband, when she was cursed and separated, and her husband said after that, ‘The child is my child, and I lied myself’. He<sup>asws</sup> said: ‘As for the woman, so she would not return to him, but the child is returned to him and would not be called as his son. There is no inheritance for him if its father does not claim him. Thus, its maternal uncle would inherit him and he would not inherit them. So if anyone were to call him as being a son of adultery, he would be whipped the Limit’.
