مَنْ مَاتَ وَ تَرَكَ دَيْناً فَعَلَيْنَا دَيْنُهُ وَ إِلَيْنَا عِيَالُهُ وَ مَنْ مَاتَ وَ تَرَكَ مَالًا فَلِوَرَثَتِهِ وَ مَنْ مَاتَ وَ لَيْسَ لَهُ مَوَالٍ فَمَالُهُ مِنَ الْأَنْفَالِ .
Translation
Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad Bin Usman, from Al Halby, (It has been narrated) from Abu Abdullah<sup>asws</sup> having said: ‘The one who dies and leaves debts, so upon us<sup>asws</sup> is his debt, and upon us<sup>asws</sup> are his dependents. And the one who dies and leaves wealth, so it is for his inheritors. And the one who dies and there is no guardian for him, so his wealth is from the spoils of war (i.e. Public treasury)’.
