محمد بن یحییٰ نے احمد بن محمد بن عیسیٰ سے، انہوں نے ابن محبوب سے، انہوں نے ربیع الاصم سے، انہوں نے حارث بن مغیرہ سے روایت کی کہ: میں نے ابو عبداللہ علیہ السلام سے ایک ایسے شخص کے بارے میں پوچھا جس کی بیوی عراق میں تھی اور اس نے بدکاری کی جبکہ وہ خود حجاز میں تھا۔ آپ نے فرمایا: اس پر زانی کی حد — سو کوڑے — مارے جائیں گے اور اسے رجم نہیں کیا جائے گا۔ میں نے کہا: پس اگر وہ اس کے ساتھ ایک ہی شہر میں ہو لیکن وہ قید میں ہو، نہ وہ اس کے پاس جا سکتا ہو اور نہ وہ اس کے پاس آ سکتی ہو — آپ کا کیا خیال ہے اگر اس نے قید میں زنا کیا؟ آپ نے فرمایا: وہ اپنی بیوی سے غائب شخص کی منزلت میں ہے — اسے سو کوڑے مارے جائیں گے۔

Translation

Muhammad Bin Yahya, from Ahmad Bin Muhammad Bin Isa, from Ibn Mahboub, from Rabie Al Asam, from Al Haris Bin Al Mugheira who said, ‘I asked Abu Abdullah^asws about a man, for him is a woman at Al-Iraq, so he committed immorality and he was at Al-Hijaz. So he^asws said: ‘He would be struck with the Penalty (<span class="iTxt">Hadd</span>) of the adultery, one hundred lashes, and he would not be stoned’. I said, ‘So if she was with him in one city, and he is imprisoned in the prison, not being able to go out to her, nor for her to come over to him. What is your^asws view, if he were to commit adultery in the prison?’ He^asws said, ‘He is at the status of the absentee from his wife. He would be whipped one hundred lashes’.
