سُئِلَ عَنِ امْرَأَةٍ كَانَ لَهَا زَوْجٌ غَائِبٌ عَنْهَا فَتَزَوَّجَتْ زَوْجاً آخَرَ قَالَ إِنْ رُفِعَتْ إِلَى الْإِمَامِ ثُمَّ شَهِدَ عَلَيْهَا شُهُودٌ أَنَّ لَهَا زَوْجاً غَائِباً وَ أَنَّ مَادَّتَهُ وَ خَبَرَهُ يَأْتِيهَا مِنْهُ وَ أَنَّهَا تَزَوَّجَتْ زَوْجاً آخَرَ كَانَ عَلَى الْإِمَامِ أَنْ يَحُدَّهَا وَ يُفَرِّقَ بَيْنَهَا وَ بَيْنَ الَّذِي تَزَوَّجَهَا قُلْتُ فَالْمَهْرُ الَّذِي أَخَذَتْ مِنْهُ كَيْفَ يُصْنَعُ بِهِ قَالَ إِنْ أَصَابَ مِنْهُ شَيْئاً فَلْيَأْخُذْهُ وَ إِنْ لَمْ يُصِبْ مِنْهُ شَيْئاً فَإِنَّ كُلَّ مَا أَخَذَتْ مِنْهُ حَرَامٌ عَلَيْهَا مِثْلُ أَجْرِ الْفَاجِرَةِ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Yunus Bin Yaqoub, from Abu Baseer, (It has been narrated) from Abu Ja’far<sup>asws</sup>, when ‘He<sup>asws</sup> was asked about a woman who had a husband, but he was absent from her, so she married another husband’. He<sup>asws</sup> said: ‘If it (the matter) is raised to the Imam<sup>asws</sup>, then four witnesses testify against her that there was a husband for her, absent, and that his materials and his news were coming to her, and that she has married another husband, it would be upon the Imam<sup>asws</sup> that he<sup>asws</sup> established the Penalty (<span class="iTxt">Hadd</span>) on her, and effected separation between her and the one she had married’. I said, ‘So the dower which she has taken from him, how should it be dealt with?’ He<sup>asws</sup> said: ‘If he can attain anything from it, so let him take it, and if he cannot attain anything from it, so everything what she has taken from it is Prohibited upon her, similar to the payment of the Immoral woman (prostitute)’.
