سُئِلَ عَنْ رَجُلٍ أَصَابَ جَارِيَةً مِنَ الْفَيْءِ فَوَطِئَهَا قَبْلَ أَنْ تُقْسَمَ قَالَ تُقَوَّمُ الْجَارِيَةُ وَ تُدْفَعُ إِلَيْهِ بِالْقِيمَةِ وَ يُحَطُّ لَهُ مِنْهَا مَا يُصِيبُهُ مِنْهَا مِنَ الْفَيْءِ وَ يُجْلَدُ الْحَدَّ وَ يُدْرَأُ عَنْهُ مِنَ الْحَدِّ بِقَدْرِ مَا كَانَ لَهُ فِيهَا فَقُلْتُ وَ كَيْفَ صَارَتِ الْجَارِيَةُ تُدْفَعُ إِلَيْهِ هُوَ بِالْقِيمَةِ دُونَ غَيْرِهِ قَالَ لِأَنَّهُ وَطِئَهَا وَ لَا يُؤْمَنُ أَنْ يَكُونَ ثَمَّ حَبَلٌ .
Translation
Ali Bin Ibrahim, from his father, from Amro Bin Usman, from a number of our companions, Abu Abdullah<sup>asws</sup>, said when He<sup>asws</sup> was asked about a man who got a slave girl from <span class="iTxt">Al-Fey</span> (war booty). So he copulated with her before the distribution’. He<sup>asws</sup> said: ‘The slave girl would be evaluated and she would be handed over to him by the price, and reduced for him from her what his share was from the war booty, and he would be whipped the Penalty (<span class="iTxt">Hadd</span>), and it would be staved off from him from the Penalty (<span class="iTxt">Hadd</span>), by the measurement of what (share) was for him with regards to her’. So I said, ‘And how come the slave girl would be handed over to him, and he is with the price, besides the others?’ He<sup>asws</sup> said: ‘Because he has copulated with her, and there is no safety that she might happen to be pregnant’.
