رَجُلَيْنِ اشْتَرَيَا جَارِيَةً فَنَكَحَهَا أَحَدُهُمَا دُونَ صَاحِبِهِ قَالَ يُضْرَبُ نِصْفَ الْحَدِّ وَ يُغَرَّمُ نِصْفَ الْقِيمَةِ إِذَا أَحْبَلَ .
Translation
Humeyd Bin Ziyad, from Al Hassan Bin Muhammad Bin Sama’at, from Ahmad Bin Al Hassan Al Maysami, from Aban, from Ismail Al Ju’fy, (It has been narrated) from Abu Ja’far<sup>asws</sup> regarding two men who bought a slave girl. So one of them copulated with her (without his companion’s knowledge). He<sup>asws</sup> said: ‘He would be struck with half the Penalty (<span class="iTxt">Hadd</span>), and compensate half the price, if she is pregnant’.
