قَضَى أَمِيرُ الْمُؤْمِنِينَ ( عليه السلام ) فِي امْرَأَةٍ وَهَبَتْ جَارِيَتَهَا لِزَوْجِهَا فَوَقَعَ عَلَيْهَا فَحَمَلَتِ الْأَمَةُ فَأَنْكَرَتِ الْمَرْأَةُ أَنَّهَا وَهَبَتْهَا لَهُ وَ قَالَتْ هِيَ خَادِمِي فَلَمَّا خَشِيَتْ أَنْ يُقَامَ عَلَى الرَّجُلِ الْحَدُّ أَقَرَّتْ بِأَنَّهَا وَهَبَتْهَا لَهُ فَلَمَّا أَقَرَّتْ بِالْهِبَةِ جَلَدَهَا الْحَدَّ بِقَذْفِهَا زَوْجَهَا .
Translation
Ali, from his father, from Ibn Abu Najran, from Aasim Bin Humeyd, from Muhammad Bin Qays, (It has been narrated) from Abu Ja’far<sup>asws</sup> having said: ‘Amir Al-Momineen<sup>asws</sup> had judged regarding a woman who gifted her maid to her husband, so he fell upon her. So the slave girl became pregnant and the woman denied that she had gifted her to him, and she said, ‘She is my servant’. So when she feared that the Penalty (<span class="iTxt">Hadd</span>) would be established upon the man, she confessed that she had gifted her to him’. (He<sup>asws</sup> said): ‘So when she has accepted having gifted, she should be whipped the Penalty (<span class="iTxt">Hadd</span>) due to her having slandered her husband’.
