John Shaqi

يُضْرَبُ حَدَّ الْحُرِّ ثَمَانِينَ إِنْ أَدَّى مِنْ مُكَاتَبَتِهِ شَيْئاً أَوْ لَمْ يُؤَدِّ قِيلَ لَهُ فَإِنْ زَنَى وَ هُوَ مُكَاتَبٌ وَ لَمْ يُؤَدِّ شَيْئاً مِنْ مُكَاتَبَتِهِ قَالَ هُوَ حَقُّ اللَّهِ يُطْرَحُ عَنْهُ مِنَ الْحَدِّ خَمْسُونَ جَلْدَةً وَ يُضْرَبُ خَمْسِينَ .


Translation

Ali Bin Ibrahim, from his father, from Ibn Mahboub, from Hammad, from Suleyman Bin Khalid, (It has been narrated) from Abu Abdullah<sup>asws</sup> having been asked about the contracted (slave) who fabricated upon a Muslim man. He<sup>asws</sup> said: ‘He would be whipped a Penalty (Hadd) of the free, eighty (lashes), whether he has paid anything from his contract or has not paid’. It was said to him<sup>asws</sup>, ‘So if he commits adultery and he is contracted, and has not paid anything from his contract?’ He<sup>asws</sup> said: ‘It is a Right of Allah<sup>azwj</sup>. Fifty lashes would be staved off from him, and he would be whipped fifty’.
