John Shaqi

رَجُلٍ أُقِيمَتْ عَلَيْهِ الْبَيِّنَةُ بِأَنَّهُ زَنَى ثُمَّ هَرَبَ قَبْلَ أَنْ يُضْرَبَ قَالَ إِنْ تَابَ فَمَا عَلَيْهِ شَيْ‏ءٌ وَ إِنْ وَقَعَ فِي يَدِ الْإِمَامِ أَقَامَ عَلَيْهِ الْحَدَّ وَ إِنْ عَلِمَ مَكَانَهُ بَعَثَ إِلَيْهِ .


Translation

Abu Ali Al Ashary, from Muhammad Bin Abdul Jabbar, from Safwan Bin Yahya, from one of his companions, from Abu Baseer, (It has been narrated) from Abu Abdullah<sup>asws</sup> regarding a man upon whom the proof is established of his having commited adultery, then he flees before he is whipped. He<sup>asws</sup> said: ‘So if he repents, there is nothing upon him, and if he falls in the hands of the Imam<sup>asws</sup>, he<sup>asws</sup> would establish the Penalty (<span class="iTxt">Hadd</span>) upon him, and if his whereabouts are known, he<sup>asws</sup> would send (a summoner) to him’.
