سُئِلَ عَنْ رَجُلٍ أَتَى رَجُلًا وَ هُوَ رَاقِدٌ فَلَمَّا صَارَ عَلَى ظَهْرِهِ أَيْقَنَ بِهِ فَبَعَجَهُ بَعْجَةً فَقَتَلَهُ فَقَالَ لَا دِيَةَ لَهُ وَ لَا قَوَدَ .
Translation
Ali Bin Ibrahim, from his father, from Amro Bin Usman, from Al Husayn Bin Khalid, (It has been narrated) from Abu Abdullah<sup>asws</sup>,said, ‘He<sup>asws</sup> was asked about a man who came to a man while he was asleep. So when he came to be upon his back, he woke up due to it, so he poked him with a knife, so he killed him’. So he<sup>asws</sup> said: ‘There is neither a wergild for him, nor a retaliation’.
