سَأَلْتُهُ عَنِ الْمُحْرِمِ يَصِيدُ الصَّيْدَ بِجَهَالَةٍ قَالَ عَلَيْهِ كَفَّارَةٌ قُلْتُ فَإِنَّهُ أَصَابَهُ خَطَأً قَالَ وَ أَيُّ شَيْءٍ الْخَطَأُ عِنْدَكَ قُلْتُ يَرْمِي هَذِهِ النَّخْلَةَ فَيُصِيبُ نَخْلَةً أُخْرَى قَالَ نَعَمْ هَذَا الْخَطَأُ وَ عَلَيْهِ الْكَفَّارَةُ قُلْتُ فَإِنَّهُ أَخَذَ طَائِراً مُتَعَمِّداً فَذَبَحَهُ وَ هُوَ مُحْرِمٌ قَالَ عَلَيْهِ الْكَفَّارَةُ قُلْتُ أَ لَسْتَ قُلْتَ إِنَّ الْخَطَأَ وَ الْجَهَالَةَ وَ الْعَمْدَ لَيْسُوا بِسَوَاءٍ فَلِأَيِّ شَيْءٍ يَفْضُلُ الْمُتَعَمِّدُ الْجَاهِلَ وَ الْخَاطِئَ قَالَ إِنَّهُ أَثِمَ وَ لَعِبَ بِدِينِهِ .
Translation
A number of our companions, from Ahmad Bin Muhammad, from Ibn Abu Nasr, (It has been narrated) from Abu Al-Hassan Al-Reza<sup>asws</sup>, said, ‘I asked him<sup>asws</sup> about the one in <span class="iTxt">Ihraam</span> hunting the prey out of ignorance. He<sup>asws</sup> said: ‘Upon him is an expiation’. I said, ‘Supposing he attained it in error?’ He<sup>asws</sup> said: ‘And which thing is (regarded) as an error with you?’ I said, ‘He pelts this palm tree, so it hits another palm tree’. He<sup>asws</sup> said: ‘Yes, this is the error, and upon him is the expiation’. I said, ‘Supposing he were to seize a bird deliberately, so he slaughters it and he is in <span class="iTxt">Ihraam</span>?’ He<sup>asws</sup> said: ‘Upon him is the expiation’. I said, ‘Did you<sup>asws</sup> not say that the error, and the ignorance, and the deliberation are not the same? So for which thing is the deliberation distinguishable from the ignorance and the error?’ He<sup>asws</sup> said: ‘It is a sin, and a playing with his Religion’.
