لَا بَأْسَ بِأَنْ يَصِيدَ الْمُحْرِمُ السَّمَكَ وَ يَأْكُلَ مَالِحَهُ وَ طَرِيَّهُ وَ يَتَزَوَّدَ وَ قَالَ أُحِلَّ لَكُمْ صَيْدُ الْبَحْرِ وَ طَعامُهُ مَتاعاً لَكُمْ قَالَ مَالِحُهُ الَّذِي يَأْكُلُونَ وَ فَصْلُ مَا بَيْنَهُمَا كُلُّ طَيْرٍ يَكُونُ فِي الْآجَامِ يَبِيضُ فِي الْبَرِّ وَ يُفْرِخُ فِي الْبَرِّ فَهُوَ مِنْ صَيْدِ الْبَرِّ وَ مَا كَانَ مِنْ صَيْدِ الْبَرِّ يَكُونُ فِي الْبَرِّ وَ يَبِيضُ فِي الْبَحْرِ وَ يُفْرِخُ فِي الْبَحْرِ فَهُوَ مِنْ صَيْدِ الْبَحْرِ .
Translation
Ali Bin Ibrahim, from his father, from Hammad, from Hareyz, from the one who informed him, (It has been narrated) from Abu Abdullah<sup>asws</sup> having said: ‘There is no problem with it provided that the one in <span class="iTxt">Ihraam</span> were to hunt the fish, and he eats its salt-water ones and its fresh-water ones, and he provides for himself’. And He<sup>azwj</sup> Said: ‘<span class="ibTxt"><a href="/#/books/quran:5#h96"><a href="/books/quran:5#h96">[5:96]</a></a> Lawful to you is the game of the sea and its food, a provision for you</span>’. He<sup>asws</sup> said: ‘Its salt-water is that which you are eating. And, the difference what is between these two is that every bird which happens to be in the bushes, and laying its eggs in the land, so it is from the hunting prey of the land; and whatever was from the prey of the land which happens to be in the land, and lays its eggs in the sea, and hatch in the sea, so it is from the prey of the sea’.
