الرَّجُلِ يَكُونُ عِنْدَ بَعْضِ أَهْلِ بَيْتِهِ مَالٌ لِأَيْتَامٍ فَيَدْفَعُهُ إِلَيْهِ فَيَأْخُذُ مِنْهُ دَرَاهِمَ يَحْتَاجُ إِلَيْهَا وَ لَا يُعْلِمُ الَّذِي كَانَ عِنْدَهُ الْمَالُ لِلْأَيْتَامِ أَنَّهُ أَخَذَ مِنْ أَمْوَالِهِمْ شَيْئاً ثُمَّ تَيَسَّرَ بَعْدَ ذَلِكَ أَيُّ ذَلِكَ خَيْرٌ لَهُ أَ يُعْطِيهِ الَّذِي كَانَ فِي يَدِهِ أَمْ يَدْفَعُهُ إِلَى الْيَتِيمِ وَ قَدْ بَلَغَ وَ هَلْ يُجْزِئُهُ أَنْ يَدْفَعَهُ إِلَى صَاحِبِهِ عَلَى وَجْهِ الصِّلَةِ وَ لَا يُعْلِمُهُ أَنَّهُ أَخَذَ لَهُ مَالًا فَقَالَ يُجْزِئُهُ أَيُّ ذَلِكَ فَعَلَ إِذَا أَوْصَلَهُ إِلَى صَاحِبِهِ فَإِنَّ هَذَا مِنَ السَّرَائِرِ إِذَا كَانَ مِنْ نِيَّتِهِ إِنْ شَاءَ رَدَّهُ إِلَى الْيَتِيمِ إِنْ كَانَ قَدْ بَلَغَ عَلَى أَيِّ وَجْهٍ شَاءَ وَ إِنْ لَمْ يُعْلِمْهُ أَنْ كَانَ قَبَضَ لَهُ شَيْئاً وَ إِنْ شَاءَ رَدَّهُ إِلَى الَّذِي كَانَ فِي يَدِهِ وَ قَالَ إِنْ كَانَ صَاحِبُ الْمَالِ غَائِباً فَلْيَدْفَعْهُ إِلَى الَّذِي كَانَ الْمَالُ فِي يَدِهِ .
Translation
Ali Bin Ibrahim, from his father, and Muhammad Bin Ismail, from Al Fazl Bin Shazaan, from Ibn Abu Umeyr and Safwan, from Abdul Rahman Bin Al Hajjaj, (It has been narrated) from Abu Al-Hassan<sup>asws</sup> regarding the man a family member of his happens to have some wealth of the orphan, so he handed it over to him. So he took some Dirhams from it which he was needy to, and the one who had the wealth of the orphan did not know that he has taken anything from the wealth of the orphan. Then he became affluent after that. Which is better for him, giving it to the one in whose hand it was or hand it over to the orphan, and he (the orphan) has reached maturity? And would it suffice if he was to hand it over to his companions upon a relevant aspect (as a gift) and not let him know that he had taken some wealth of his?’ So he<sup>asws</sup> said: ‘Whichever of that he does would suffice for him, when he delivers it to his companion, for this is from the secrecies when it was from his intention to return it to the orphan, if he had attained maturity, upon whichever aspects he so desires to, even if he does not let him know of it that he had grabbed something of his; and if he so desires to he can return it to the one in whose hand it (originally) was’. And he<sup>asws</sup> said: ‘If the owner of the wealth was absent, so let him hand it over to the one in whose hand it (originally) was’.
