سَأَلْتُ أَبَا الْحَسَنِ مُوسَى ( عليه السلام ) قُلْتُ لَهُ أَ يَصْلُحُ لِي أَنْ أَشْتَرِيَ مِنَ الْقَوْمِ الْجَارِيَةَ الْآبِقَةَ وَ أُعْطِيَهُمُ الثَّمَنَ وَ أَطْلُبَهَا أَنَا قَالَ لَا يَصْلُحُ شِرَاؤُهَا إِلَّا أَنْ تَشْتَرِيَ مِنْهُمْ مَعَهَا شَيْئاً ثَوْباً أَوْ مَتَاعاً فَتَقُولَ لَهُمْ أَشْتَرِي مِنْكُمْ جَارِيَتَكُمْ فُلَانَةَ وَ هَذَا الْمَتَاعَ بِكَذَا وَ كَذَا دِرْهَماً فَإِنَّ ذَلِكَ جَائِزٌ .
Translation
Ahmad Bin Muhammad, from Ibn Mahboub, from Rafa’at Al Nakhaas who said, ‘I asked Abu Al-Hassan Musa<sup>asws</sup> saying to him, ‘Is it correct for me that I buy the absconded slave girl from the people and give them the price, and seek her myself?’ He<sup>asws</sup> said: ‘Buying her is not correct except if you were to buy from them something (else) along with her, clothes or goods, so you should be saying to them, ‘I am buying from you so and so slave girl from you and these goods with such and such Dirhams’. So that would be allowed’.
