سَأَلْتُهُ عَنْ رَجُلٍ كَانَتْ لِي عَلَيْهِ مِائَةُ دِرْهَمٍ عَدَداً قَضَانِيهَا مِائَةَ دِرْهَمٍ وَزْناً قَالَ لَا بَأْسَ مَا لَمْ يَشْتَرِطْ قَالَ وَ قَالَ جَاءَ الرِّبَا مِنْ قِبَلِ الشُّرُوطِ إِنَّمَا تُفْسِدُهُ الشُّرُوطُ .
Translation
A number of our companions, from Ahmad Bin Muhammad Bin Isa, from Muhammad Bin Isa, from Yahya Bin Al Hajjaj, from Khalid Bin Al Hajjaj who said, ‘I asked him<sup>asws</sup> about a man who had (a debt) upon him for me of one hundred Dirhams numberwise, so he paid it with one hundred Dirhams by weight. He<sup>asws</sup> said: ‘There is no problem with what had not been stipulated’. And he<sup>asws</sup> said: ‘The usury comes before the stipulations. But rather the stipulations spoil it’.
