قُلْتُ لِأَبِي عَبْدِ اللَّهِ ( عليه السلام ) أَتَقَبَّلُ الْأَرْضَ بِالثُّلُثِ أَوِ الرُّبُعِ فَأُقَبِّلُهَا بِالنِّصْفِ قَالَ لَا بَأْسَ بِهِ قُلْتُ فَأَتَقَبَّلُهَا بِأَلْفِ دِرْهَمٍ فَأُقَبِّلُهَا بِأَلْفَيْنِ قَالَ لَا يَجُوزُ قُلْتُ كَيْفَ جَازَ الْأَوَّلُ وَ لَمْ يَجُزِ الثَّانِي قَالَ لِأَنَّ هَذَا مَضْمُونٌ وَ ذَلِكَ غَيْرُ مَضْمُونٍ
Translation
Sahl Bin Ziyad, from Ahmad Bin Muhammad from Abdul Kareem, from Al Halby who said, ‘I said to Abu Abdullah<sup>asws</sup>, ‘The land is leased for a third (of the produce), or the quarter, so it is sub-leased for the half’. He<sup>asws</sup> said: ‘There is no problem with it’. I said, ‘Supposing it is leased for a thousand Dirhams and sub-leased it for two thousand?’ He<sup>asws</sup> said: ‘Not allowed’. I said, ‘How come the first is allowed and the second is not allowed?’ He<sup>asws</sup> said: ‘Because this is guaranteed, and that is without a guarantee’.
