سَأَلْتُهُ عَنْ رَجُلٍ أَدْخَلَ جَارِيَةً يَتَمَتَّعُ بِهَا ثُمَّ أُنْسِيَ أَنْ يَشْتَرِطَ حَتَّى وَاقَعَهَا يَجِبُ عَلَيْهِ حَدُّ الزَّانِي قَالَ لَا وَ لَكِنْ يَتَمَتَّعُ بِهَا بَعْدَ النِّكَاحِ وَ يَسْتَغْفِرُ اللَّهَ مِمَّا أَتَى .
Translation
A number of our companions, from Ahmad Bin Muhammad, from one of his companions, from Zur’at Bin Muhammad, from Sama’at who said, ‘I asked him<sup>asws</sup> about a man slept with a slave girl by way of <span class="iTxt">Mut’a</span> with her, then forgets that he should be stipulating (<span class="iTxt">Mahr </span>and term) until he has slept with her. Would it Obligate the legal punishment (<span class="iTxt">Hadd</span>) of the adulterer upon him?’ He<sup>asws</sup> said: ‘No, but he enjoyed with her after the marriage, and he should seek Forgiveness of Allah<sup>azwj</sup> from what he has done’.
