"مَنْ قَتَلَ مُؤْمِناً عَلَى دِينِهِ فَذَاكَ اَلْمُتَعَمِّدُ اَلَّذِي، قَالَ اَللَّهُ عَزَّ وَ جَلَّ فِي كِتَابِهِ وَ أَعَدَّ لَهُ عَذَاباً عَظِيماً" قُلْتُ فَالرَّجُلُ يَقَعُ بَيْنَهُ وَ بَيْنَ اَلرَّجُلِ شَيْءٌ فَيَضْرِبُهُ بِسَيْفِهِ فَيَقْتُلُهُ قَالَ "لَيْسَ ذَاكَ اَلْمُتَعَمِّدَ اَلَّذِي قَالَ اَللَّهُ عَزَّ وَ جَلَّ".

5171 - سماعہ نے ابا عبداللہ علیہ السلام سے اللہ تعالیٰ کے قول کے بارے میں پوچھا۔ اور جو کوئی جان بوجھ کر مؤمن کو قتل کرے، اس کا بدلہ جہنم ہے۔ انہوں نے علیہ السلام فرمایا: "جو کوئی اپنے دین کی وجہ سے مؤمن کو قتل کرے، وہی وہ جان بوجھ کر قتل کرنے والا ہے جس کے بارے میں اللہ تعالیٰ نے اپنی کتاب میں فرمایا ہے اور اس کے لیے عظیم عذاب تیار کیا ہے۔" میں نے کہا: "پھر ایک آدمی کے درمیان اور دوسرے آدمی کے درمیان کوئی بات ہو جاتی ہے، تو وہ اسے تلوار سے مار کر قتل کر دیتا ہے۔" انہوں نے علیہ السلام فرمایا: "وہ قصداً قتل نہیں ہے جس کا ذکر اللہ تعالیٰ نے فرمایا۔"
Translation
Hadith.5171 - Samaah asked Abu Abdullah Imam Jafar ibn Muhammad Al-Sadiq (as) about the saying of Allah (swt), the Almighty and Majestic: "And whoever kills a believer intentionally, his recompense is Hell" (Surah An-Nisa 4:93). Imam (as) said: "Whoever kills a believer because of his faith, that is the intentional killer whom Allah (swt), the Almighty and Majestic, mentioned in His (swt) Book and for whom He (swt) has prepared a great punishment." I asked: "What about a man who has a dispute with another man, and in the heat of the moment strikes him with a sword and kills him?" Imam (as) said: "That is not the intentional killing that Allah (swt), the Almighty and Majestic, referred to."
