John Shaqi

: سَأَلَهُ بَعْضُ آلِ زُرَارَةَ عَنْ رَجُلٍ قَطَعَ لِسَانَ رَجُلٍ أَخْرَسَ فَقَالَ "إِنْ كَانَ وَلَدَتْهُ أُمُّهُ وَ هُوَ أَخْرَسُ فَعَلَيْهِ اَلدِّيَةُ وَ إِنْ كَانَ لِسَانُهُ ذَهَبَ بِوَجَعٍ أَوْ آفَةٍ بَعْدَ مَا كَانَ يَتَكَلَّمُ فَإِنَّ عَلَى اَلَّذِي قَطَعَ ثُلُثَ دِيَةِ لِسَانِهِ".


اردو

الْحَسَن بْن مَحْبُوب نے ہِشَام بْن سَالِم سے روایت کی، جو أَبُو بَصِير سے، جو أَبُو جَعْفَر علیہ السلام سے روایت کرتے ہیں، جنہوں نے فرمایا: زرارہ کے خاندان کے کچھ افراد نے ان سے ایک ایسے شخص کے بارے میں پوچھا جس نے ایک گونگے شخص کی زبان کاٹ دی۔ انہوں نے فرمایا: اگر اس کی ماں نے اسے گونگا پیدا کیا ہے تو اس پر دیہ واجب ہے؛ لیکن اگر اس کی زبان بات کرنے کے بعد درد یا بیماری کی وجہ سے ضائع ہو گئی ہو تو جس نے زبان کاٹا ہے اسے زبان کے دیہ کا ایک تہائی ادا کرنا ہوگا۔


Translation

Hadith.5328 - Al-Hasan ibn Mahbub narrated from Hisham ibn Salim from Abu Baṣir from Abu Jafar Imam Muhammad ibn Ali Al-Baqir (as) that someone from the family of Zurarah asked Imam (as) about a man who cut off the tongue of a mute person. Imam (as) said: "If his mother gave birth to him mute, then the full blood money (diyyah) is due. But if his tongue was lost due to an illness or an affliction after he had been able to speak, then the one who cut it off must pay one-third of the diyyah of the tongue."
