: سَأَلْتُهُ عَنِ اَلرَّجُلِ يَحْفِرَ اَلْبِئْرَ فِي دَارِهِ أَوْ فِي أَرْضِهِ فَقَالَ "أَمَّا مَا حَفَرَ فِي مِلْكِهِ فَلَيْسَ عَلَيْهِ ضَمَانٌ وَ أَمَّا مَا حَفَرَ فِي اَلطَّرِيقِ أَوْ فِي غَيْرِ مِلْكِهِ فَهُوَ ضَامِنٌ لِمَا يَسْقُطُ فِيهَا".

زُرعہ اور عُثمان بن عیسیٰ نے سماعہ سے روایت کی، جنہوں نے کہا: میں نے ان سے اس شخص کے بارے میں پوچھا جو اپنے گھر یا زمین میں کنواں کھودتا ہے۔ انہوں نے فرمایا: “جو وہ اپنی ملکیت میں کھودے، اس پر کوئی ضمانت نہیں۔ لیکن جو وہ راستے یا اپنی ملکیت کے علاوہ کہیں کھودے، تو وہ اس چیز کا ضامن ہے جو اس میں گر جائے۔”
Translation
Hadith.5341 - Zurah and Uthman ibn Isa narrated from Samaah, who said: I asked Imam (as) about a man who digs a well in his house or on his land. Imam (as) said: "If he digs it within his own property, there is no liability upon him. But if he digs it in a public road or in a place that does not belong to him, then he is liable for anything that falls into it."
