اردو

اگر کوئی مرد بیٹا چھوڑ جائے اور نہ بیوی چھوڑے اور نہ والدین، تو سارا مال بیٹے کا ہوتا ہے۔ اسی طرح اگر دو یا اس سے زیادہ ہوں تو مال ان کے درمیان برابر تقسیم ہوتا ہے۔ اسی طرح اگر وہ بیٹی چھوڑے اور نہ شوہر اور نہ والدین، تو سارا مال بیٹی کا ہوتا ہے، کیونکہ اللہ تعالیٰ نے مال اولاد کے لیے مقرر کیا ہے، اور بیٹی کو نصف کا حق صرف والدین کے ساتھ دیا ہے۔ اسی طرح اگر دو یا اس سے زیادہ بیٹیاں ہوں تو سارا مال ان کا برابر ہوتا ہے۔ اگر وہ ایک بیٹی، بیٹے کی بیٹی، اور بیٹے کا بیٹا چھوڑ جائے، اور نہ کوئی زوجہ ہو اور نہ والدین، تو سارا مال بیٹی کا ہوتا ہے۔ بچے کی اولاد والد کے ساتھ کچھ نہیں وراثت پاتی کیونکہ جو خود سے قریب ہوتا ہے وہ مال کا زیادہ حق دار اور مستحق ہوتا ہے بہ نسبت اس کے جو دوسرے کے ذریعے قریب ہوتا ہے، اور جو مرنے والے کے نسب میں ایک درجے سے قریب ہوتا ہے وہ مال کا زیادہ حق دار ہوتا ہے بہ نسبت اس کے جو نسب میں ایک درجے سے دور ہوتا ہے۔ اگر وہ بیٹا اور بیٹی یا بیٹے اور بیٹیاں چھوڑ جائے تو سارا مال ان کا ہوتا ہے، اور مرد کو دو عورتوں کے برابر حصہ ملتا ہے، جب کہ ان کے ساتھ نہ کوئی زوجہ ہو اور نہ والدین۔ اگر وہ بیٹی، بھائی، بہن، اور دادا چھوڑ جائے تو سارا مال بیٹی کا ہوتا ہے۔ بیٹی کے ساتھ کوئی وراثت میں شریک نہیں ہوتا سوائے بیٹے، زوجہ، اور والدین کے۔ اسی طرح، مرد اولاد کے ساتھ کوئی وراثت میں شریک نہیں ہوتا سوائے زوجہ اور والدین کے، جیسا کہ اللہ تعالیٰ نے اپنی کتاب میں ذکر فرمایا ہے۔


Translation

If a man leaves behind a son and does not leave a wife or parents, then the entire estate belongs to the son. Similarly, if there are two or more sons, the estate is divided equally among them. If he leaves a daughter and no husband or parents, then the entire estate belongs to the daughter because Allah (swt), the Almighty and Majestic, has allocated the estate to the offspring and specified half of the share for a daughter only in the presence of parents. Likewise, if there are two or more daughters, the estate is divided equally among them. If he leaves a daughter, a granddaughter (daughter's daughter), and a grandson (daughter's son), and there is no husband or parents, the entire estate belongs to the daughter. The grandchildren do not inherit alongside the direct offspring because those who are closer in lineage take precedence over those further away. The closer relation to the deceased is more entitled to the estate than those who are further removed. If he leaves both a son and a daughter, or multiple sons and daughters, the entire estate is divided among them with the male receiving twice the share of the female, provided there is no spouse or parents. If he leaves a daughter, a brother, a sister, and a grandfather, the entire estate belongs to the daughter. No one inherits alongside a daughter except a son, a husband, or the parents. Similarly, no one inherits alongside a male offspring except the spouse and the parents, according to what Allah (swt), the Almighty, has mentioned in His (swt) Book.
