إِذَا طَلَّقَ الرَّجُلُ الْمَرْأَةَ وَ هِيَ حُبْلَى أَنْفَقَ عَلَيْهَا حَتَّى تَضَعَ حَمْلَهَا فَإِذَا وَضَعَتْهُ أَعْطَاهَا أَجْرَهَا وَ لَا يُضَارَّهَا إِلَّا أَنْ يَجِدَ مَنْ هُوَ أَرْخَصُ أَجْراً مِنْهَا فَإِنْ هِيَ رَضِيَتْ بِذَلِكَ الْأَجْرِ فَهِيَ أَحَقُّ بِابْنِهَا حَتَّى تَفْطِمَهُ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Muhammad Bin Ismail, from Muhammad Bin Al Fazal, from Abu Al Sabbah Al Kinany, (It has been narrated) from Abu Abdullah<sup>asws</sup> having said: ‘When the man divorces the woman and she is pregnant, he has to spend upon her until she places her load (gives birth). So when she has place it, he gives her recompense, and should not harm her except if he finds one who is of a cheaper recompense than her (for the breast-feeding). So if she (agrees to) breast-feed with that recompense, she is more deserving with (breast-feeding) her son until she weans him’.
