فِي الْمُكَاتَبِ إِذَا أَدَّى بَعْضَ مُكَاتَبَتِهِ فَقَالَ إِنَّ النَّاسَ كَانُوا لَا يَشْتَرِطُونَ وَ هُمُ الْيَوْمَ يَشْتَرِطُونَ وَ الْمُسْلِمُونَ عِنْدَ شُرُوطِهِمْ فَإِنْ كَانَ شُرِطَ عَلَيْهِ أَنَّهُ إِنْ عَجَزَ رَجَعَ وَ إِنْ لَمْ يُشْتَرَطْ عَلَيْهِ لَمْ يَرْجِعْ وَ فِي قَوْلِ اللَّهِ عَزَّ وَ جَلَّ فَكاتِبُوهُمْ إِنْ عَلِمْتُمْ فِيهِمْ خَيْراً قَالَ كَاتِبُوهُمْ إِنْ عَلِمْتُمْ أَنَّ لَهُمْ مَالًا قَالَ وَ قَالَ فِي الْمُكَاتَبِ يَشْتَرِطُ عَلَيْهِ مَوْلَاهُ أَنْ لَا يَتَزَوَّجَ إِلَّا بِإِذْنٍ مِنْهُ حَتَّى يُؤَدِّيَ مُكَاتَبَتَهُ قَالَ يَنْبَغِي لَهُ أَنْ لَا يَتَزَوَّجَ إِلَّا بِإِذْنٍ مِنْهُ فَإِنَّ لَهُ شَرْطَهُ .
Translation
Ali Bin Ibrahim, from his father, from Ibn Abu Umeyr, from Hammad, from Al Halby, (It has been narrated) from Abu Abdullah<sup>asws</sup> having said regarding the contracted slave when he pays off part of his contract. So he<sup>asws</sup> said: ‘The people were not stipulating conditions, and today they are stipulating, and are submitting in their stipulations. So if it was such that there was a condition stipulated upon him that if he was frustrated (from paying) he would be returned (to slavery), (so he would be), and if it was not stipulated upon him, he would not be returned’. And regarding the Words of Allah<sup>azwj</sup> Mighty and Majestic <span class="ibTxt"><a href="/#/books/quran:24#h33"><a href="/books/quran:24#h33">[24:33]</a></a> give them the writing if you know any good in them</span>. He<sup>asws</sup> said: ‘Contract them if you know that for them would be wealth’. He (the narrator) said, ‘And he<sup>asws</sup> said regarding the contracted slave: ‘If his master stipulates upon him that he would not get married except by his permission until he has paid off his contract, it is befitting for him not to get married except by permission from him, for it is a condition for him’.
