John Shaqi

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلام ) عَنْ مُكَاتَبَةٍ أَدَّتْ ثُلُثَيْ مُكَاتَبَتِهَا وَ قَدْ شُرِطَ عَلَيْهَا إِنْ عَجَزَتْ فَهِيَ رَدٌّ فِي الرِّقِّ وَ نَحْنُ فِي حِلٍّ مِمَّا أَخَذْنَا مِنْهَا وَ قَدِ اجْتَمَعَ عَلَيْهَا نَجْمَانِ قَالَ تُرَدُّ وَ تَطِيبُ لَهُمْ مَا أَخَذُوا مِنْهَا وَ قَالَ لَيْسَ لَهَا أَنْ تُؤَخِّرَ النَّجْمَ بَعْدَ حَلِّهِ شَهْراً وَاحِداً إِلَّا بِإِذْنِهِمْ .


Translation

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ali Bin Al Hakam, from Muawiya Bin Wahab who said, ‘I asked Abu Abdullah<sup>asws</sup> about a contracted woman who has paid off two-thirds of her contract, and it had been stipulated upon her that if she was frustrated (from paying), so she would be returned to the slavery, and we would be in the leeway from what we take from her, and two installments had gathered upon her. He<sup>asws</sup> said: ‘She would be returned, and make good for them what they take from her’. And he<sup>asws</sup> said: ‘It is not for her that she delays the installment after the passing by of one month except by their permission’.
