Translation
Ali Bin Ibrahim, from his father, from Abdul Rahman Bin Abu Najran, from Aasim Bin Humeyr, from Muhammad Bin Qays, (It has been narrated) from Abu Ja’farasws having said: ‘Amir Al-Momineenasws said: ‘Whichever man leaves a concubine having a child for her or a child in her belly, or not having a child for her, so if her lord were to emancipate her, so she is emancipated, and if he does not emancipate her until she dies (so be it), for there has preceded with regards to it a Book of Allahazwj Mighty and Majestic, and the Book of Allahazwj is more rightful. So if there was a child for her, and she has left wealth, so it would be made to be in the share of her child’. And Amir Al-Momineenasws has judged regarding a man who left a slave girl and she had given birth to a daughter from him, and she was small without being able to manifest the speech. So her mother was emancipated. So the guardians of the father of the slave girl disputed with regards to her, so heasws allowed her emancipation for the mother’.
