إِذَا أَوْصَى الرَّجُلُ إِلَى أَخِيهِ وَ هُوَ غَائِبٌ فَلَيْسَ لَهُ أَنْ يَرُدَّ عَلَيْهِ وَصِيَّتَهُ لِأَنَّهُ لَوْ كَانَ شَاهِداً فَأَبَى أَنْ يَقْبَلَهَا طَلَبَ غَيْرَهُ .

ابو علی الاشعری، عبداللہ بن محمد سے، علی بن الحکم سے، سیف بن عمیرہ سے، منصور بن حازم سے، ابو عبداللہ علیہ السلام سے روایت کی گئی ہے کہ آپ نے فرمایا: جب کوئی شخص اپنے بھائی کو اپنا وصی بنائے اور وہ غائب ہو تو اس کے لیے جائز نہیں کہ وہ اس وصیت کو رد کرے، کیونکہ اگر وہ موجود ہوتا اور قبول کرنے سے انکار کرتا تو کسی اور کو تلاش کیا جاتا۔
Translation
Abu Ali Al Ashary, from Abdullah Bin Muhammad, from Ali Bin Al Hakam, from Sayf Bin Umeyra, from Mansour Bin Hazim, (It has been narrated) from Abu Abdullah<sup>asws</sup> having said: ‘If the man appoints his brother as an executor and he is absent, so it is not up to him to reject to him his appointments as an executor, because if he was present and refused, someone else would be sought to accept it’.
