John Shaqi

سَأَلْتُ أَبَا عَبْدِ اللَّهِ ( عليه السلام ) عَنِ امْرَأَةٍ اسْتَوْدَعَتْ رَجُلًا مَالًا فَلَمَّا حَضَرَتْهَا الْوَفَاةُ قَالَتْ لَهُ إِنَّ الْمَالَ الَّذِي دَفَعْتُهُ إِلَيْكَ لِفُلَانَةَ وَ مَاتَتِ الْمَرْأَةُ فَأَتَى أَوْلِيَاؤُهَا الرَّجُلَ فَقَالُوا لَهُ إِنَّهُ كَانَ لِصَاحِبَتِنَا مَالٌ وَ لَا نَرَاهُ إِلَّا عِنْدَكَ فَاحْلِفْ لَنَا أَنَّ مَا لَهَا قِبَلَكَ شَيْ‏ءٌ أَ فَيَحْلِفُ لَهُمْ فَقَالَ إِنْ كَانَتْ مَأْمُونَةً عِنْدَهُ فَيَحْلِفُ لَهُمْ وَ إِنْ كَانَتْ مُتَّهَمَةً فَلَا يَحْلِفُ وَ يَضَعُ الْأَمْرَ عَلَى مَا كَانَ فَإِنَّمَا لَهَا مِنْ مَالِهَا ثُلُثُهُ .


Translation

Muhammad Bin Yahya, from Ahmad Bin Muhammad Bin Isa, from Ali Bin Al Noman, from Ibn Muskan, from Al A’ala Baya’a Al Sabiry who said, ‘I asked Abu Abdullah<sup>asws</sup> about a woman who entrusted a man with wealth. So when the death presented itself to her, she said to him, ‘The wealth which I handed over to you is for so and so’. And the woman died. So her guardians came over to the man, so they said to him, ‘There used to be wealth for our companion and we do not see it except it is with you, therefore swear an oath to us that it there is nothing for her’. Is it for him that he should swear an oath to them?’ So he<sup>asws</sup> said: ‘If she was trustworthy in his presence, so he should swear an oath to them, and if he was an accused, so he should not swear an oath, and should place the matter upon what it was. But rather, for her, from her wealth, was a third’.
