سَأَلْتُهُ عَنْ رَجُلٍ مَاتَ وَ تَرَكَ غُلَاماً مَمْلُوكاً فَشَهِدَ بَعْضُ الْوَرَثَةِ أَنَّهُ حُرٌّ فَقَالَ إِنْ كَانَ الشَّاهِدُ مَرْضِيّاً جَازَتْ شَهَادَتُهُ فِي نَصِيبِهِ وَ اسْتُسْعِيَ فِيمَا كَانَ لِغَيْرِهِ مِنَ الْوَرَثَةِ .
Translation
Hameed Bin Ziyad, from Al Hassan Bin Muhammad Bin Sama’at, from one of his companions, from Aban Bin Usman, from Mansour Bin Hazim, (It has been narrated) from Abu Abdullah<sup>asws</sup>, said, ‘I asked him<sup>asws</sup> about a man who died and left an owned slave. So one of the inheritors testifies that he is free. So he<sup>asws</sup> said: ‘If he was present during illness, his testimony is allowed with regards to his share, and he (the slave) would have to work with regards to what was for the others from the inheritors’.
