دَفَعَ إِلَيَّ صَفْوَانُ كِتَاباً لِمُوسَى بْنِ بَكْرٍ فَقَالَ لِي هَذَا سَمَاعِي مِنْ مُوسَى بْنِ بَكْرٍ وَ قَرَأْتُهُ عَلَيْهِ فَإِذَا فِيهِ مُوسَى بْنُ بَكْرٍ عَنْ عَلِيِّ بْنِ سَعِيدٍ عَنْ زُرَارَةَ قَالَ هَذَا مِمَّا لَيْسَ فِيهِ اخْتِلَافٌ عِنْدَ أَصْحَابِنَا عَنْ أَبِي عَبْدِ اللَّهِ وَ عَنْ أَبِي جَعْفَرٍ ( عليه السلام ) أَنَّهُمَا سُئِلَا عَنِ امْرَأَةٍ تَرَكَتْ زَوْجَهَا وَ أُمَّهَا وَ ابْنَتَيْهَا فَقَالَ لِلزَّوْجِ الرُّبُعُ وَ لِلْأُمِّ السُّدُسُ وَ لِلِابْنَتَيْنِ مَا بَقِيَ لِأَنَّهُمَا لَوْ كَانَا رَجُلَيْنِ لَمْ يَكُنْ لَهُمَا شَيْءٌ إِلَّا مَا بَقِيَ وَ لَا تُزَادُ الْمَرْأَةُ أَبَداً عَلَى نَصِيبِ الرَّجُلِ لَوْ كَانَ مَكَانَهَا وَ إِنْ تَرَكَ الْمَيِّتُ أُمّاً وَ أَباً وَ امْرَأَةً وَ ابْنَةً فَإِنَّ الْفَرِيضَةَ مِنْ أَرْبَعَةٍ وَ عِشْرِينَ سَهْماً لِلْمَرْأَةِ الثُّمُنُ ثَلَاثَةُ أَسْهُمٍ مِنْ أَرْبَعَةٍ وَ عِشْرِينَ وَ لِأَحَدِ الْأَبَوَيْنِ السُّدُسُ أَرْبَعَةُ أَسْهُمٍ وَ لِلِابْنَةِ النِّصْفُ اثْنَا عَشَرَ سَهْماً وَ بَقِيَ خَمْسَةُ أَسْهُمٍ هِيَ مَرْدُودَةٌ عَلَى سِهَامِ الِابْنَةِ وَ أَحَدِ الْأَبَوَيْنِ عَلَى قَدْرِ سِهَامِهِمَا وَ لَا يُرَدُّ عَلَى الْمَرْأَةِ شَيْءٌ وَ إِنْ تَرَكَ أَبَوَيْنِ وَ امْرَأَةً وَ بِنْتاً فَهِيَ أَيْضاً مِنْ أَرْبَعَةٍ وَ عِشْرِينَ سَهْماً لِلْأَبَوَيْنِ السُّدُسَانِ ثَمَانِيَةُ أَسْهُمٍ لِكُلِّ وَاحِدٍ مِنْهُمَا أَرْبَعَةُ أَسْهُمٍ وَ لِلْمَرْأَةِ الثُّمُنُ ثَلَاثَةُ أَسْهُمٍ وَ لِلِابْنَةِ النِّصْفُ اثْنَا عَشَرَ سَهْماً وَ بَقِيَ سَهْمٌ وَاحِدٌ مَرْدُودٌ عَلَى الِابْنَةِ وَ الْأَبَوَيْنِ عَلَى قَدْرِ سِهَامِهِمْ وَ لَا يُرَدُّ عَلَى الْمَرْأَةِ شَيْءٌ وَ إِنْ تَرَكَ أَباً وَ زَوْجاً وَ ابْنَةً فَلِلْأَبِ سَهْمَانِ مِنِ اثْنَيْ عَشَرَ وَ هُوَ السُّدُسُ وَ لِلزَّوْجِ الرُّبُعُ ثَلَاثَةُ أَسْهُمٍ مِنِ اثْنَيْ عَشَرَ وَ لِلِابْنَةِ النِّصْفُ سِتَّةُ أَسْهُمٍ مِنِ اثْنَيْ عَشَرَ وَ بَقِيَ سَهْمٌ وَاحِدٌ مَرْدُودٌ عَلَى الِابْنَةِ وَ الْأَبِ عَلَى قَدْرِ سِهَامِهِمَا وَ لَا يُرَدُّ عَلَى الزَّوْجِ شَيْءٌ وَ لَا يَرِثُ أَحَدٌ مِنْ خَلْقِ اللَّهِ مَعَ الْوَلَدِ إِلَّا الْأَبَوَانِ وَ الزَّوْجُ وَ الزَّوْجَةُ فَإِنْ لَمْ يَكُنْ وَلَدٌ وَ كَانَ وَلَدُ الْوَلَدِ ذُكُوراً كَانُوا أَوْ إِنَاثاً فَإِنَّهُمْ بِمَنْزِلَةِ الْوَلَدِ وَ وَلَدُ الْبَنِينَ بِمَنْزِلَةِ الْبَنِينَ يَرِثُونَ مِيرَاثَ الْبَنِينَ وَ وَلَدُ الْبَنَاتِ بِمَنْزِلَةِ الْبَنَاتِ يَرِثُونَ مِيرَاثَ الْبَنَاتِ وَ يَحْجُبُونَ الْأَبَوَيْنِ وَ الزَّوْجَ وَ الزَّوْجَةَ عَنْ سِهَامِهِمُ الْأَكْثَرِ وَ إِنْ سَفَلُوا بِبَطْنَيْنِ وَ ثَلَاثَةٍ وَ أَكْثَرَ يَرِثُونَ مَا يَرِثُ وَلَدُ الصُّلْبِ وَ يَحْجُبُونَ مَا يَحْجُبُ وَلَدُ الصُّلْبِ .
Translation
Humeyd Bin Ziyad, from Al Hassan Bin Muhammad Bin Sama’at who said, ‘Safwan handed over to me a book of Musa Bin Bakr, so he said to me, ‘This is what I heard from Musa Bin Bakr and read it out to him’. So, in it was that Musa Bin Bakr, from Ali Bin Saeed, from Zurara who said, ‘This is from what there is no differing therein in the presence of our companions, from Abu Abdullah<sup>asws</sup>, and from Abu Ja’far<sup>asws</sup>, having both been asked about a woman who left her husband, and her mother, and her two daughters. So he<sup>asws</sup> said: ‘For the husband is the quarter, and for the mother is the sixth, and for the two daughters is what remains because both of them, had they been men, there would not be for the two of them anything except what remains, and (the share of) the woman does not exceed the share of the man, even if she were to be in his place. And if the deceased leaves a mother, and a father, and a wife, and a daughter, so the Obligatory (legislated shares) are from twenty four shares – for the wife would be an eighth, being three shares from twenty four shares; for the two parents would be two sixths, being eight shares, for each one of them, four shares; and for the wife would be the eight, being three shares, and for the daughter would be the half, being twelve shares, and the remaining one share would revert upon the daughter and the two parents in accordance of their shares, and nothing would revert to the wife (from that one remaining share). And if he left a father, and a husband, and a daughter, so for the father would be two shares from twelve, and it is the sixth; and for the husband would be the quarter, being three shares from twelve; and for the daughter would be the half, being six shares from twelve, and the remaining one share would revert upon the daughter and the father upon the measurement of both their shares, and nothing would revert to the husband (from that one remaining share). And, no one from the creatures of Allah<sup>azwj</sup> would inherit along with the child except for the two parents, and the husband, and the wife. So if there does not happen to be a child, and there was a child of the child (grandchild), whether a male or a female, so they would be at the status of the parent, and the children of the sons are at the status of the sons, inheriting the inheritance of the sons, and the children of the daughter are at the status of the daughter, inheriting the inheritance of the daughters, veiling the two parents, and the husband, and the wife from their larger shares. And they are of a lower generation, with two, and three, and more, they would be inheriting what the child of the lineage inherits, and they would be blocking what the child of the lineage blocks’.
