غُلَامٍ صَغِيرٍ لَمْ يُدْرِكْ ابْنِ عَشْرِ سِنِينَ زَنَى بِامْرَأَةٍ قَالَ يُجْلَدُ الْغُلَامُ دُونَ الْحَدِّ وَ تُجْلَدُ الْمَرْأَةُ الْحَدَّ كَامِلًا قِيلَ لَهُ فَإِنْ كَانَتْ مُحْصَنَةً قَالَ لَا تُرْجَمُ لِأَنَّ الَّذِي نَكَحَهَا لَيْسَ بِمُدْرِكٍ وَ لَوْ كَانَ مُدْرِكاً رُجِمَتْ .

علی ابن ابراہیم نے اپنے والد سے اور محمد بن یحیٰی نے احمد بن محمد سے، سب نے ابن محبوب سے، انہوں نے ابو ایوب الخزاز سے، انہوں نے سلیمان بن خالد سے، انہوں نے ابو بصیر سے، انہوں نے ابو عبداللہ علیہ السلام سے روایت کی ایک چھوٹے لڑکے کے بارے میں جو بالغ نہیں ہوا تھا، دس سال کا بیٹا تھا، جس نے ایک عورت کے ساتھ زنا کیا۔ آپ نے فرمایا: 'لڑکے کو حد سے کم کوڑے لگائے جائیں گے، اور عورت کو پوری حد لگائی جائے گی۔' آپ سے عرض کیا گیا: 'اگر وہ شادی شدہ ہو؟' آپ نے فرمایا: 'اسے رجم نہیں کیا جائے گا، کیونکہ جس نے اس سے مجامعت کی وہ بالغ نہیں تھا، اور اگر وہ بالغ ہوتا تو اسے رجم کیا جاتا۔'
Translation
Ali Bin Ibrahim, from his father and Muhammad Bin Yahya, from Ahmad Bin Muhammad, altogether from Ibn Mahboub, from Abu Ayoub Al Khazaz, from Suleyman Bin Khalid, from Abu Baseer, (It has been narrated) from Abu Abdullah<sup>asws</sup> regarding a young boy who had not matured yet, a boy ten years of age, committed adultery with a woman. He<sup>asws</sup> said: ‘The boy would be whipped less than the Penalty (<span class="iTxt">Hadd</span>), and the woman would be (whipped) with the complete Penalty (<span class="iTxt">Hadd</span>)’. It was said to him<sup>asws</sup>, ‘So if she was married?’ He<sup>asws</sup> said: ‘She would not be stoned, because the one who copulated with her had not matured yet, and if he had been mature, she would have been stoned’.
