John Shaqi

سَأَلْتُهُ عَنْ رَجُلٍ أَعْتَقَ نِصْفَ جَارِيَتِهِ ثُمَّ قَذَفَهَا بِالزِّنَى قَالَ فَقَالَ أَرَى عَلَيْهِ خَمْسِينَ جَلْدَةً وَ يَسْتَغْفِرَ اللَّهَ عَزَّ وَ جَلَّ مِنْ فِعْلِهِ قُلْتُ أَ رَأَيْتَ إِنْ جَعَلَتْهُ فِي حِلٍّ مِنْ قَذْفِهِ إِيَّاهَا وَ عَفَتْ عَنْهُ قَالَ لَا ضَرْبَ عَلَيْهِ إِذَا عَفَتْ عَنْهُ مِنْ قَبْلِ أَنْ تَرْفَعَهُ .


Translation

Muhammad Bin Yahya, from Ahmad Bin Muhammad, from Ibn Mahboub, from Hisham Bin Salim, from Hamza Bin Humran, (It has been narrated) from one of the two (5<sup>th</sup> or 6<sup>th</sup> Imam<sup>asws</sup>), said, ‘I asked him<sup>asws</sup> about a man who emancipated (librated) half of his slave girl, then accused her with the adultery. So he<sup>asws</sup> said: ‘I<sup>asws</sup> view upon him being fifty lashes, and he should repent to Allah<sup>azwj</sup> Mighty and Majestic for his deed’. I said, ‘What is your<sup>asws</sup> view of her having freed him from his accusation and forgiven him about it?’ He<sup>asws</sup> said: ‘There is no whipping upon him if she has forgiven him before it (the matter) is raised (before a judge)’.
