قَالَ أَبُو عَبْدِ اللَّهِ ( عليه السلام ) الْحَدُّ فِي الْخَمْرِ إِنْ شُرِبَ مِنْهَا قَلِيلًا أَوْ كَثِيراً قَالَ ثُمَّ قَالَ أُتِيَ عُمَرُ بِقُدَامَةَ بْنِ مَظْعُونٍ وَ قَدْ شَرِبَ الْخَمْرَ وَ قَامَتْ عَلَيْهِ الْبَيِّنَةُ فَسَأَلَ عَلِيّاً ( عليه السلام ) فَأَمَرَهُ أَنْ يَجْلِدَهُ ثَمَانِينَ فَقَالَ قُدَامَةُ يَا أَمِيرَ الْمُؤْمِنِينَ لَيْسَ عَلَيَّ حَدٌّ أَنَا مِنْ أَهْلِ هَذِهِ الْآيَةِ لَيْسَ عَلَى الَّذِينَ آمَنُوا وَ عَمِلُوا الصَّالِحاتِ جُناحٌ فِيما طَعِمُوا قَالَ فَقَالَ عَلِيٌّ ( عليه السلام ) لَسْتَ مِنْ أَهْلِهَا إِنَّ طَعَامَ أَهْلِهَا لَهُمْ حَلَالٌ لَيْسَ يَأْكُلُونَ وَ لَا يَشْرَبُونَ إِلَّا مَا أَحَلَّهُ اللَّهُ لَهُمْ ثُمَّ قَالَ عَلِيٌّ ( عليه السلام ) إِنَّ الشَّارِبَ إِذَا شَرِبَ لَمْ يَدْرِ مَا يَأْكُلُ وَ لَا مَا يَشْرَبُ فَاجْلِدُوهُ ثَمَانِينَ جَلْدَةً .
Translation
Yunus, from Abdullah Bin Sinan who said, ‘Abu Abdullah<sup>asws</sup> said: ‘The Penalty (<span class="iTxt">Hadd</span>) (would be established) regarding the wine, if it is drunk from it, a little or more’. Then he<sup>asws</sup> said: ‘They came to Umar with Qadamat Bin Mazoun, and he had drunk the wine, and the proof was established upon him. So he (Umar) asked Ali<sup>asws</sup>, so he<sup>asws</sup> ordered that he should be whipped eighty (lashes). So Qadamat said, ‘O Amir Al-Momineen<sup>asws</sup>! There is no Penalty (<span class="iTxt">Hadd</span>) upon me. I am from the ones rightful of this Verse <span class="ibTxt"><a href="/#/books/quran:5#h93"><a href="/books/quran:5#h93">[5:93]</a></a> On those who believe and do righteous deeds there is no blame for what they eat</span>’. So Ali<sup>asws</sup> said: ‘You are not from its rightful ones. The food of its rightful ones is Permissible unto them. They are not eating and drinking excep what Allah<sup>azwj</sup> has Permitted to them’. Then Ali<sup>asws</sup> said: ‘The drinker, when he drinks (wine), he does not know what he eats and what he drinks’. So he<sup>asws</sup> whipped him eighty lashes’.
