میں نے آپ سے ایک ایسے شخص کے بارے میں پوچھا جس نے ایک شخص کو جان بوجھ کر قتل کیا۔ معاملہ والی کے پاس پیش کیا گیا اور والی نے اسے مقتول کے اولیاء کے حوالے کر دیا تاکہ وہ اسے قتل کریں۔ پھر کچھ لوگ ان پر ٹوٹ پڑے اور اولیاء کے ہاتھوں سے قاتل کو چھڑا لیا۔ تو آپ نے فرمایا: میں سمجھتا ہوں کہ جن لوگوں نے اولیاء کے ہاتھوں سے قاتل کو چھڑایا انہیں قید کیا جائے یہاں تک کہ وہ قاتل کو پیش کریں۔ کہا گیا: اگر قاتل مر جائے اور وہ قید میں ہوں تو؟ آپ نے فرمایا: اگر وہ مر جائے تو ان پر دیت لازم ہے جسے وہ سب مل کر مقتول کے اولیاء کو ادا کریں گے۔

Translation

Muhammad Bin Yahya from Ahmad Bin Muhammad and Ali Bin Ibrahim from his father, both together from Ibn Mahboub, from Abu Ayoub, from Hareyz, (The narrator) says: ‘I asked Abu Abdullah^asws about a man who killed a man deliberately. So it was raised to the governor. So the governor handed him over to the guardians of the killed one to let them kill him. So a group of people leapt upon them, so they had the killer released from the hands of the guardians. So he^asws said: ‘I^asws see that the one who released the killer from the hands of the guardians should be imprisoned until they can come up with the killer’. It was said, ‘So if the killer died and they are (still) in prison?’ He^asws said: ‘So if he dies, then upon them is the wergild, which they all have to pay it together to the guardians of the killed one’.
