سُئِلَ أَبُو جَعْفَرٍ ( عليه السلام ) عَنْ رَجُلٍ قَتَلَ رَجُلًا عَمْداً فَلَمْ يُقَمْ عَلَيْهِ الْحَدُّ وَ لَمْ تَصِحَّ الشَّهَادَةُ عَلَيْهِ حَتَّى خُولِطَ وَ ذَهَبَ عَقْلُهُ ثُمَّ إِنَّ قَوْماً آخَرِينَ شَهِدُوا عَلَيْهِ بَعْدَ مَا خُولِطَ أَنَّهُ قَتَلَهُ فَقَالَ إِنْ شَهِدُوا عَلَيْهِ أَنَّهُ قَتَلَهُ حِينَ قَتَلَهُ وَ هُوَ صَحِيحٌ لَيْسَ بِهِ عِلَّةٌ مِنْ فَسَادِ عَقْلِهِ قُتِلَ بِهِ وَ إِنْ يَشْهَدُوا عَلَيْهِ بِذَلِكَ وَ كَانَ لَهُ مَالٌ يُعْرَفُ دُفِعَ إِلَى وَرَثَةِ الْمَقْتُولِ الدِّيَةُ مِنْ مَالِ الْقَاتِلِ وَ إِنْ لَمْ يَتْرُكْ مَالًا أُعْطِيَ الدِّيَةُ مِنْ بَيْتِ الْمَالِ وَ لَا يَبْطُلُ دَمُ امْرِئٍ مُسْلِمٍ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, and Ali Bin Ibrahim, from his father, both together from Ibn Mahboub, from Hazir Al Sayrafi, from Bureyd Bin Muawiya Al Ajaly who said, ‘Abu Ja’far<sup>asws</sup> was asked about a man who killed a man deliberately. So the legal penalty (<span class="iTxt">Hadd</span>) had not been established upon him, and the testimonies had not been reckoned against him, he became mad and his intellect went away. Then another group testified against him after he had gone mad that he had killed him’. (He<sup>asws</sup>) said: ‘When he killed him, he was correct, there was no reason from the spoiling of his intellect, (thus) he would be killed due to it. And if he is testified against with that, and there was known wealth for him, it would be handed over to the inheritors of the killed one. The wergild is from the wealth of the killer. And if he did not leave wealth, the wergild would be given from the public treasury, and there would be no invalidation of the blood of a Muslim person’.
