سُئِلَ عَنْ رَجُلٍ قَتَلَ امْرَأَةً خَطَأً وَ هِيَ عَلَى رَأْسِ الْوَلَدِ تَمْخَضُ قَالَ عَلَيْهِ الدِّيَةُ خَمْسَةُ آلَافِ دِرْهَمٍ وَ عَلَيْهِ لِلَّذِي فِي بَطْنِهَا غُرَّةٌ وَصِيفٌ أَوْ وَصِيفَةٌ أَوْ أَرْبَعُونَ دِينَاراً .
Translation
Ibn Mahboub, from Abu Ayoun, from Al Halby, and Abu Ubeyda, (It has been narrated) from Abu Abdullah<sup>asws</sup>, said, ‘He<sup>asws</sup> was asked about a man who killed a woman in error, and she was pregnant with a child. He<sup>asws</sup> said: ‘Upon him is the wergild of five thousand Dirhams (for killing her), and upon him for that which was in her belly for negligence, is a male servant, or a female servant, or forty Dinars’.
