رَجُلٍ افْتَضَّ جَارِيَةً يَعْنِي امْرَأَتَهُ فَأَفْضَاهَا قَالَ عَلَيْهِ الدِّيَةُ إِنْ كَانَ دَخَلَ بِهَا قَبْلَ أَنْ تَبْلُغَ تِسْعَ سِنِينَ قَالَ فَإِنْ كَانَ أَمْسَكَهَا وَ لَمْ يُطَلِّقْهَا فَلَا شَيْءَ عَلَيْهِ وَ إِنْ كَانَ دَخَلَ بِهَا وَ لَهَا تِسْعُ سِنِينَ فَلَا شَيْءَ عَلَيْهِ إِنْ شَاءَ أَمْسَكَ وَ إِنْ شَاءَ طَلَّقَ .
Translation
Muhammad Bin Yahya, from Ahmad Bin Muhammad, and Ali Bin Ibrahim, from his father, both together from Ibn Mahboub, from Al Haris Bin Muhammad Bin Al Noman Sahib Al Taaq, from Bureyd Bin Muawiya, (It has been narrated) from Abu Ja’far<sup>asws</sup> regarding a man who caused injuries to the genitals of his slave girl, meaning his wife. He<sup>asws</sup> said: ‘Upon him is the (complete) wergild if he had copulated with her before she had reached nine years of age’. He<sup>asws</sup> said: ‘If he were to keep her and not divorce her, so there is nothing upon him, and if he had copulated with her, and she was nine years of age, so there is nothing upon him; if he so desires to he keeps, and if he so desires to, he divorces’.
